Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Quit the Zits (the “Service”), operated by Budgey Platforms, LLC (“we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Quit the Zits is an AI-assisted skincare application. You submit photos of your skin and information about yourself, and the Service uses automated analysis to generate a personalized skincare routine, track changes over time, and provide general guidance. The Service is for informational and cosmetic purposes only.

2. Not Medical Advice

Quit the Zits is not a medical device and does not provide medical advice, diagnosis, or treatment. The analysis, scores, product suggestions, and any other content are generated by artificial intelligence and may be incomplete, inaccurate, or unsuitable for you. They are not a substitute for professional care from a dermatologist, physician, or other qualified healthcare provider. Always seek the advice of a qualified professional with any questions about a medical condition, and never disregard or delay seeking professional advice because of something you read or received through the Service. If you think you may have a medical emergency, contact your doctor or emergency services immediately. Discontinue use of any product or routine that causes irritation or an adverse reaction.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, Billing & Auto-Renewal

The Service is offered on a paid subscription basis. Pricing and billing intervals (monthly or annual) are shown at checkout. Payments are processed by our payment processor, Stripe; we do not store your full card details.

  • Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price, and your payment method is charged, until you cancel.
  • Cancellation. You may cancel at any time from your account settings or by contacting us. Cancellation stops future renewals; it does not retroactively refund the current period except as described below.
  • Price changes. We may change subscription prices. We will give you reasonable advance notice, and changes apply to the next billing period.

6. 60-Day Money-Back Guarantee

If you are not satisfied with the Service, you may request a full refund of your most recent subscription payment within 60 days of that charge by contacting us at support@quitthezits.com. The guarantee applies to one refund per customer and covers the most recent payment only. Upon refund, your subscription will be canceled and your access ends. We reserve the right to decline requests we reasonably determine to be fraudulent or abusive.

7. Your Content

You retain ownership of the photos and information you submit (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit Your Content solely to operate and provide the Service to you — including sending it to our AI and infrastructure providers for analysis. You represent that you have the right to submit Your Content and that doing so does not violate any law or third-party right. Our handling of Your Content is described in our Privacy Policy.

8. Acceptable Use

You agree not to:

  • submit images of anyone other than yourself without their consent, or images of minors;
  • use the Service for any unlawful, harmful, or fraudulent purpose;
  • attempt to reverse engineer, scrape, overload, or interfere with the Service or its security;
  • resell, sublicense, or commercially exploit the Service without our written permission.

9. Intellectual Property

The Service, including its software, design, text, and branding, is owned by Budgey Platforms, LLC and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.

10. Third-Party Services

The Service relies on third parties — including AI processing (xAI), payments (Stripe), storage (Cloudflare), and hosting — and may surface third-party product links. We are not responsible for third-party products, websites, or services, and your use of them may be subject to their own terms.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result, analysis, or recommendation will be accurate or achieve any particular outcome.

12. Limitation of Liability

To the maximum extent permitted by law, Budgey Platforms, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Budgey Platforms, LLC from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
